National Nil Sports Photo/Video Release Form

I hereby give my permission to National Nil Sports to use any photos and/or videotaped material taken of my child/children or myself during the workouts – individual and/or group experiences, etc. for their website, social media sites, and/or promotional materials. The photos and/or videotaped material will only be used for their website purposes and for presentations to attract potential clients. As with all data consent, I may at any time withdraw permission for photographs and/or video footage of my child or myself to be used in this project.

I acknowledge that there is no compensation for allowing my child or myself, or any likeness therein, to be photographed or videotaped.

The pictures and/or videotapes will be kept for approximately the same length as the duration of the websites existence or until we have no need for them. During this time, they will remain securely stored on our computers, flash drives and websites/social media. No one other than our staff will have access to the data. After the data is no longer needed, the photographs and/or videotape material will be returned and/or destroyed.

The collective effort and sacrifice of San Francisco residents staying at home limited the spread of COVID-19. But community transmission of COVID-19 within San Francisco continues, including transmission by individuals who are infected and contagious, but have no symptoms. Infected persons are contagious 48 hours before developing symptoms (“pre-symptomatic”), and many are contagious without ever developing symptoms (“asymptomatic”). Pre-symptomatic and asymptomatic people are likely unaware that they have COVID-19.

The availability of childcare is an important step in the resumption of activities. However, the decision by the Health Officer to allow childcare and summer camps for all families at facilities that follow required safety rules, does not mean that attending childcare is free of risk. Enrolling a child in childcare could increase the risk of the child becoming infected with COVID-19. While the majority of children that become infected do well, there is still much more to learn about coronavirus in children, City and County of Department of Public Health San Francisco Health Officer Directive Health Officer Directive No. 2020- 14 3 including from recent reports of Multisystem Inflammatory Syndrome in Children (MIS-C).

Each parent or guardian must determine for themselves if they are willing to take the risk of enrolling their child in childcare, including whether they need to take additional precautions to protect the health of their child and others in the household. They should particularly consider the risks to household members who are adults 60 years or older, or anyone who has an underlying medical condition. Parents and guardians may want to discuss these risks and their concerns with their pediatrician or other health care provider. More information about COVID-19, MIS-C, and those at higher risk for serious illness is available on the Centers for Disease Control and Prevention website at https://www.cdc.gov/coronavirus/2019-ncov/.

I understand the risks associated with enrolling my child in childcare, and agree to assume the risks to my child and my household. I also agree to follow all safety requirements that the childcare program/summer camp imposes as a condition of enrolling my child.

National NIL Exposure Events

WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT
1. In consideration for receiving permission to participate in National NIL Sports experiences at any gym or facility, I hereby release, waive, discharge, and covenant not to sue National NIL Sports, and all subsidiaries, affiliates, institutions, and organizations associated with National NIL Sports (hereinafter referred to as “releasees”) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or any property belonging to me, whether caused by the negligence of the releasees, or otherwise, while participating in such activity, or while in, on, or upon the premises where the activity is being conducted. 2. I am fully aware of the risks involved and hazards connected with participation in National NIL Sports experiences, including but not limited to broken legs, sprained ankles, and/or virus exposure. I voluntarily elect to participate in said activity with full knowledge that said activity may be hazardous to me and/or my family. I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by me, or any loss or damage to property owned by me, as a result of being engaged in such activity, whether caused by the negligence of releasees or otherwise. 3. I further hereby agree to indemnify and hold harmless the releasees from any loss, liability, damage, or costs, including court costs and attorney fees, that they may incur due to my participation in said activity, whether caused by negligence of releasees or otherwise. 4. I understand that National NIL Sports does not maintain any health insurance policy covering any circumstance arising from my participation in this event or any activity associated with or facilitating that participation. As such, I am aware that I should review my personal insurance policies. 5. It is my express intent that this Waiver of Liability and Hold Harmless Agreement shall bind the members of my family and spouse, if I am alive, and my heirs, assigns, and personal representative, if I am deceased, and shall be deemed as a release, waiver, discharge, and covenant not to sue the above-named releasees. I hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the State of California. 6. In signing this release, I acknowledge and represent that I have read the foregoing Waiver of Liability and Hold Harmless Agreement, understand it, and sign it voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this release for full, adequate, and complete consideration fully intending to be bound by same.
